Article 1 – Definitions

The following definitions apply to these terms:

1. Ancillary contract: a contract under which the consumer acquires goods, digital content and/or services in connection with a distance contract, supplied by the trader or by a third party under an agreement with the trader.

2. Withdrawal period: the period during which the consumer may exercise the right of withdrawal.

3. Consumer: a natural person acting for purposes outside their trade, business, craft or profession.

4. Day: a calendar day.

5. Digital content: data produced and supplied in digital form.

6. Continuing agreement: a contract for the regular supply of goods, services and/or digital content over a specified period.

7. Durable medium: any means, including email, enabling the consumer or trader to store information addressed personally to them for a period appropriate to its purpose and reproduce it unchanged.

8. Right of withdrawal: the consumer’s right to cancel a distance contract within the withdrawal period.

9. Trader: the natural or legal person offering goods, access to digital content and/or services to consumers at a distance.

10. Distance contract: a contract concluded between a trader and consumer within an organised distance-sales system, using one or more means of distance communication up to and including the time of conclusion.

11. Model withdrawal form: the European model withdrawal form provided in the appendix to these terms.

12. Means of distance communication: a means of concluding a contract without the consumer and trader being present together in the same place.

Article 3 – Applicability

1. These terms and conditions apply to every offer made by the trader and every distance contract concluded between the trader and a consumer.

2. The terms will be made available to the consumer before the distance contract is concluded. Where this is not reasonably possible, the trader will explain where the terms may be inspected and that they will be sent free of charge as soon as possible on request.

3. Where the contract is concluded electronically, the terms may be provided electronically beforehand in a form that the consumer can readily save on a durable medium. If this is not reasonably possible, the trader will indicate where the terms are available electronically and offer to send them electronically or otherwise without charge.

4. Where specific product or service terms also apply, the preceding information requirements apply accordingly. In the event of conflicting terms, the consumer may rely on whichever applicable provision is more favourable to them.

Article 4 – The offer

1. Any limited validity period or special conditions will be clearly stated in the offer.

2. The offer will provide a complete and accurate description of the goods, digital content and/or services, in sufficient detail to allow proper assessment. Images will fairly represent the products or services offered. Obvious mistakes or errors do not bind the trader.

3. Each offer will give consumers sufficient information to understand their rights and obligations upon accepting it.

Article 5 – The agreement

1. Subject to paragraph 4, the contract is formed when the consumer accepts the offer and satisfies any applicable conditions.

2. If the consumer accepts electronically, the trader will promptly acknowledge receipt electronically. Until receipt is confirmed, the consumer may terminate the contract.

3. For electronic contracts, the trader will implement appropriate technical and organisational security measures for data transmission and maintain a secure online environment. Appropriate payment security measures will be applied where electronic payment is available.

4. Within legal limits, the trader may assess whether the consumer can meet payment obligations and other relevant circumstances before entering into a distance contract. Where there are sound reasons not to proceed, the trader may refuse an order or request with reasons, or attach special conditions.

5. No later than delivery, the trader will provide in writing or on an accessible durable medium: (a) the visiting address for complaints; (b) information on exercising or excluding the right of withdrawal; (c) statutory and additional warranties and after-sales service; (d) the total price including taxes, applicable delivery costs and payment, delivery or performance arrangements; (e) cancellation requirements for agreements lasting over one year or indefinitely; and (f) the model withdrawal form where withdrawal rights apply.

6. For ongoing deliveries, paragraph 5 applies only to the first delivery.

Article 6 – Right of withdrawal

Goods:

1. A consumer may withdraw from a contract to purchase goods without giving a reason during a period of at least 14 days. The trader may ask for a reason but cannot require the consumer to give one.

2. The withdrawal period begins on the day after the consumer or a third party designated by them, other than the carrier, receives the goods. For multiple goods ordered together and delivered separately, it begins after the last item is received; for multiple consignments or parts, after the final consignment or part; for regular goods deliveries, after the first item is received. The trader may refuse an order of items with different lead times if the consumer was clearly informed of this before ordering.

Services and digital content not supplied on a tangible medium:

3. Consumers may withdraw from the relevant agreement within at least 14 days without giving reasons, which the trader may request but not require.

4. This period starts on the day following conclusion of the contract.

Extended withdrawal period if information is missing:

5. If the trader has not supplied the legally required information about withdrawal or the model form, the withdrawal period expires twelve months after the original withdrawal period ends.

6. If the missing information is supplied within twelve months after the start of the original period, the withdrawal period expires 14 days after the consumer receives that information.

Article 7 – Consumer obligations during the withdrawal period

1. During the withdrawal period, the consumer must handle the goods and packaging with care. Goods may only be unpacked or used as necessary to establish their nature, characteristics and functioning, as would be permitted when inspecting goods in a shop.

2. The consumer is liable only for diminished value caused by handling beyond what is necessary under paragraph 1.

3. The consumer is not liable for diminished value if the trader failed to provide all legally required information about the right of withdrawal before or at the conclusion of the contract.

Article 8 – Exercising the right of withdrawal and return costs

1. The consumer must notify the trader of withdrawal within the withdrawal period, using the model withdrawal form or another unequivocal statement.

2. The consumer must return or hand over the goods as soon as possible and no later than 14 days after communicating withdrawal, unless the trader has offered to collect them. The deadline is met if goods are sent within that 14-day period.

3. Goods must be returned with all supplied accessories and, where reasonably possible, in their original condition and packaging, following the trader’s reasonable and clear return instructions.

4. The consumer bears the risk and burden of proving proper and timely exercise of the right of withdrawal.

5. The consumer bears the direct cost of returning goods where informed in advance, unless the trader has agreed to bear that cost.

6. Where a consumer expressly requested that a service or relevant non-packaged gas, water or electricity supply begin during the withdrawal period, they must pay a proportionate amount for the performance already provided when withdrawing.

7. No costs are due for those services or utilities if the legally required withdrawal or cost information or form was not provided, or the consumer did not expressly request performance to begin during the withdrawal period.

8. No costs are payable for wholly or partly supplied digital content not delivered on a tangible medium if the consumer did not expressly agree to early performance, did not acknowledge the loss of withdrawal rights, or the trader failed to confirm that acknowledgement.

9. Exercising the right of withdrawal automatically cancels all ancillary contracts.

Article 9 – Trader obligations following withdrawal

1. Where electronic withdrawal notifications are accepted, the trader will promptly acknowledge receipt.

2. The trader will refund all payments received for the withdrawn goods, including the cost of standard delivery, without undue delay and within 14 days after being informed of the withdrawal. Unless the trader offers to collect the goods, it may withhold reimbursement until the goods have been received or the consumer provides evidence of return, whichever is earlier.

3. Refunds will be made using the original payment method unless the consumer agrees otherwise, without fees for the consumer.

4. If the consumer selected a more expensive delivery method than the cheapest standard option, the additional cost need not be refunded.

Article 10 – Exclusions from the right of withdrawal

The trader may exclude the right of withdrawal for the following legally recognised categories only where the exclusion was clearly stated in the offer, or otherwise in good time before the contract was concluded:

1. Goods or services whose price depends on financial-market fluctuations beyond the trader’s control that may occur during the withdrawal period.

2. Contracts concluded at public auctions managed by an auctioneer with the possibility of personal attendance.

3. Fully performed service contracts, where performance began with the consumer’s express prior consent and the consumer acknowledged losing the right of withdrawal on full performance.

4. Accommodation services for a specified date or period (other than residential accommodation), transport of goods, car rental or catering.

5. Leisure activities for a specified date or period.

6. Goods made to the consumer’s specifications, not prefabricated and manufactured on an individual choice or decision, or clearly personalised.

7. Goods liable to deteriorate or expire rapidly.

8. Sealed goods unsuitable for return for health-protection or hygiene reasons when the seal has been broken after delivery.

9. Goods that by their nature become inseparably mixed with other items after delivery.

10. Certain alcoholic drinks with prices agreed at conclusion but delivery after at least 30 days and values dependent on market fluctuations beyond the trader’s control.

11. Sealed audio or video recordings or computer software after the seal has been broken.

12. Newspapers, periodicals or magazines other than subscriptions.

13. Digital content not supplied on a tangible medium, if performance began with the consumer’s express prior consent and acknowledgement that the right of withdrawal would be lost.

Article 11 – Prices

1. Prices will not be increased during the stated offer validity period except as a result of changes in VAT rates.

2. Variable prices may be offered for goods or services whose prices depend on financial-market fluctuations beyond the trader’s control. The link to those fluctuations and any indicative prices will be stated in the offer.

3. Price increases within three months of contract conclusion are permitted only where required by legislation or statutory provisions.

4. Price increases after three months are permitted only if agreed and either based on legislation or accompanied by the consumer’s right to cancel effective on the date the price increase takes effect.

5. Prices stated in offers to consumers include VAT.

Article 12 – Performance and additional warranties

1. The trader guarantees that the goods and services conform to the contract, the stated specifications, reasonable requirements of quality and fitness for normal use, and the laws and government regulations in force when the contract was concluded. Fitness for a special purpose applies where agreed.

2. Any additional warranty from the trader, supplier, manufacturer or importer never restricts the consumer’s statutory rights and claims against the trader in the event of non-performance.

3. An additional warranty is any undertaking granting the consumer rights or remedies beyond the warranty provider’s statutory obligations.

Article 13 – Delivery and fulfilment

1. The trader will take the greatest possible care when receiving and fulfilling orders and handling requests for services.

2. The delivery location is the address supplied by the consumer.

3. Accepted orders will be fulfilled promptly, and no later than 30 days unless a different period is agreed. If delivery is delayed, or an order cannot be fulfilled in whole or in part, the consumer will be notified within 30 days after ordering. In that event the consumer may cancel without charge and may be entitled to damages.

4. After cancellation under paragraph 3, the trader will promptly refund amounts paid.

5. The trader bears the risk of damage to or loss of goods until delivery to the consumer or to a previously designated representative known to the trader, unless expressly agreed otherwise.

Article 14 – Ongoing contracts: duration, cancellation and renewal

Cancellation

1. Consumers may cancel indefinite-term contracts for regular supply of goods or services at any time in accordance with agreed cancellation rules and with no more than one month’s notice.

2. Fixed-term regular supply contracts may be cancelled at the end of the agreed term, subject to no more than one month’s notice.

3. These contracts may be cancelled at any time, without being restricted to a particular date or period, at least by the same means used to conclude them, and with no longer notice period than the trader has stipulated for itself.

Renewal

4. Fixed-term contracts for regular supply generally may not be automatically renewed for another fixed term.

5. Fixed-term subscriptions to daily, news or weekly newspapers and magazines may exceptionally be renewed for up to three months if the consumer may cancel at the end of the renewed term with no more than one month’s notice.

6. Automatic renewal for an indefinite period is permitted only if the consumer may cancel at any time with no more than one month’s notice, or three months for newspapers or magazines delivered less than once a month.

7. Fixed introductory or trial newspaper or magazine subscriptions end automatically and will not be renewed silently.

Duration

8. For an agreement lasting more than one year, the consumer may cancel after one year at any time with no more than one month’s notice, unless reasonableness and fairness exceptionally prevent early termination.

Article 15 – Payment

1. Available payment methods and any fees are clearly displayed before the order is completed.

2. Consumers may voluntarily choose full advance payment. For goods yet to be delivered, Detect does not require consumers to pay more than 50% in advance; in accordance with applicable law, an option is available under which at least 50% is paid upon or after delivery.

3. Any payment deadlines are stated with the chosen payment method or in the contract.

4. Consumers must report errors in their payment details as soon as possible.

5. If payment is overdue, the trader will notify the consumer of the arrears and allow the legally required 14-day period to pay. Statutory interest and, where permitted, statutory extrajudicial collection charges may then become payable, provided all legal conditions are met.

Article 16 – Complaints procedure

1. Complaints about orders, goods or services may be submitted directly to Detect Metaaldetectors at [email protected] or 06 30 99 50 35.

2. Please describe your complaint as fully and clearly as possible. We handle complaints carefully and seek to resolve them through discussion.

3. You will receive a substantive response within 14 days of receipt. If more time is required, we will acknowledge receipt within that period and indicate when you can expect a fuller reply.

4. This procedure does not affect your statutory consumer rights, including rights relating to defective goods.

Article 17 – Disputes

1. Contracts with Detect Metaaldetectors are governed by Dutch law. Any mandatory consumer protection applicable under the laws of the country in which the consumer habitually resides is preserved in accordance with applicable rules.

2. We first seek to resolve disputes amicably through our complaints procedure.

3. If no resolution is reached, the dispute may be brought before a court having jurisdiction under the applicable law. The consumer’s statutory right to bring proceedings before a competent court is unaffected.

4. Detect Metaaldetectors is not affiliated with Stichting Webshop Keurmerk and does not offer its associated dispute-resolution procedure or industry guarantee.

Article 18 – Additional or differing provisions

Additional or different provisions may not disadvantage the consumer and must be recorded in writing or in another form that the consumer can readily store on a durable medium.
